Joe Samnik Bio

2014-04-15 21.54.15-3 Joe is entering his 49th year of practice limited to tree and landscape consulting and the dispute resolution process. He received the Edward W. Bok award for recognition of lifetime achievement in the excellence of arboriculture. Joe was the founding president of the International Society of Arboriculture (ISA), Florida Chapter and sat on the Board of Directors for six years as the Consultant’s Representative and Education Chair. He is also a past president of the Association of Eminent Domain Professionals (AEDP), and their current president. Joe is licensed through the Department of Agriculture and Consumer Services to prescribe and treat pests on trees and landscapes. He has been issued a provider number by the Department of Business and Professional Regulation, State of Florida. He has presented at over 90 International, and state conferences. His abstracts on tree assessments were selected for presentation at five (5) International Tree Conferences. His formula for appraising the value of roadside vegetation was included in Rule Chapter 14-40 of the Florida Highway Beautification Act. Joe is a recognized expert witness in small claims, civil, criminal, eminent domain and federal courts of law. He has been involved as an expert in over 700 litigation assignments. Looking Back on 50 Years

I am about to enter my fifth decade of service to my clients.  That’s a long time. 2,244 payrolls without missing a beat.  That’s a lot of payrolls.  I’ve caught my bride of 30 years squeezing ketchup into boiling water so we could have soup that night because we didn’t have grocery money. I’ve watched seven of my protégés crumble under the pressure of working with me; one, actually dropping to her knees crying hysterically that she couldn’t take the pressure anymore. I watched all seven go on to start and run their own successful businesses with the skills they learned from me and my practice.

It’s About Justice

If we are working on a matter together and you should happen to call me at 2:00 o’clock in the morning there is little doubt but that I will pick up the phone on the first ring.  I am walking the hallways.  I am walking in my front yard.  I am thinking.  Of course there are the myriad of documents, exhibits, testimony, and other material to sort out in my mind and be prepared to present under oath.

When I first heard his name I immediately forgot it, but that is easily explained away as I was in the fine state of Louisiana and attending federal court as an expert in a 1.7 million dollar tree matter.  The caller turned out to be an attorney who had already checked me out as it relates to my expertise in plant and tree appraisals, and had only two questions to ask of me:  1. What is Toomer’s Corner? and 2.  What is the mascot of Auburn University?  When I replied that I didn’t know the answer to either question, he immediately retained me.  Then he instructed me to Google, H-A-R-V-E-Y   U-P-D-Y-K-E.  For the next hour or so I learned that Mr. Updyke was pretty much the most hated man in Alabama- especially at Auburn University (Go Tigers).

Professional Engineers

He has presented the ANSI A300 – Part 5, Tree, Shrub, and Other Woody Plant Maintenance – Standard Practices to the Society of Professional Engineers for their continuing education. He also has presented the same seminar for the Construction Licensing Board for their members’ continuing educational requirements. Joe has presented at two (2) South Eastern Conference (SEBC) meetings.

Developers

Joe is an approved provider for landscape architect CEUs by the Department of Business and Professional Regulations (DBPR)
Joe has lectured

for the University of Florida, Institute of Food and Agricultural Sciences (IFAS) on signs and symptoms of plant and tree failures. His presentation, “Dead Trees Do Talk”, created a paradigm for plant diagnosticians. His seminars on soil sciences have been presented to landscape architects for Continuing Education Units (CEUs).
He was a guest speaker for the annual conference of the Florida Chapter of Landscape Architects (2003) and the national convention of the Association of Landscape Architects (2006).
His seminars on trees, including the reduction of ordinance assessments are recognized for Continuing Education Units (CEUs) by the Florida Chapter, Society of Landscape Architects. He was a presenter at the National Conference of Landscape Architects in Ft. Lauderdale, Florida (2005).

Insurance Companies

Joe’s partnership with a national insurance research group has enabled him to provide continuing education by presenting Plants & Trees – The Ultimate Test of Value. This course’s goal is to offer legally tested and upheld approaches to valuing plants and trees while offering actual case studies of erroneous or fraudulent claims and how they were detected.
Joe has conducted Tree Appraisal Seminars for numerous professional organizations including four (4) international tree conventions and numberous annual tree conventions in the state of Florida.
His appraisal seminars have been given at the University of Florida and Rutgers University.
He chaired education and programs for the Association of Eminent Domain Professionals (AEDP)
